Terms of Service
Terms of Service
1. General:
Using the PortoPro (Ola Labunets, NIF: 299225909) website implies agreement to these terms. The site aims to provide information about real estate and consulting services in Portugal.
2. Disclaimer:
The professional information presented on the site does not replace individual legal, financial, planning, tax, or architectural advice. Any investment decision is made solely at the investor's risk. Real estate involves various economic risks, and the company does not guarantee future returns or any certain outcome.
3. Governing Law & Jurisdiction:
These terms are governed by Portuguese Law. A party alleging breach of contract or damage may be required to prove its claim via an expert opinion on Portuguese law, presented at its own expense. This burden-of-proof provision applies to B2B commercial disputes; for consumers, the ordinary burden-of-proof rules under applicable law apply instead. Any legal disputes shall be resolved exclusively in the courts of Comarca do Porto, Portugal, provided that nothing herein derogates from the right of an EU-resident consumer to bring proceedings in the courts of their own place of residence, to the extent such a right exists under applicable mandatory law (including the Brussels Ia Regulation).
4. Regulatory Status:
PortoPro is not a licensed real estate broker (AMI) and does not perform customer identification or due-diligence (KYC) procedures as part of its ongoing activities. Should any service on the site come to require compliance with specific regulatory requirements (including anti-money laundering law) in the future, this will be assessed and addressed separately, including an update to these terms, before that service is provided.
5. Cancellation Policy (For Israeli Residents):
In accordance with the Israeli Consumer Protection Law, Israeli residents are entitled to cancel a transaction within 14 days from the date of placing the order or receiving the disclosure document (whichever is later), subject to a cancellation fee of 5% of the transaction price or 100 NIS (whichever is lower).
6. Dispute Resolution & Mandatory Mediation:
Before pursuing any court action, the parties agree to first undertake a mediation process of at least 30 days in Porto, Portugal (or virtually, per Portuguese mediation rules). Formal notice of a dispute must be sent by registered mail to the company's official Porto address before any further step is taken. This process does not derogate from a consumer's right to approach a competent court at any time under applicable mandatory law, and is not a mandatory precondition for a consumer to the extent mandatory law prohibits such a requirement.
7. Liability Cap:
The company's total liability to the client for any damage, loss, expense, or cause of action shall not, in any event, exceed the amount actually paid by the client for the specific service provided. Nothing above limits or excludes liability for gross negligence, willful misconduct, death or personal injury, or any other case where applicable mandatory law prohibits limiting liability.
